Macon County People Against a Littered State (PALS)
Recently, I had the pleasure of
meeting several very dedicated Macon County PALS volunteers. These
volunteers will go to
almost any limit for the
cleanliness of our streets and communities, including stepping up when our county government, sheriff, and
the judicial system fail to help keep our roadways free of litter and hazards and attractive to interested
businesses. These volunteers are frequently seen picking up trash along our streets, vacant lots, and
streams not only for appearance sake but health and safety reasons as well. While young and senior citizens
are braving the elements picking up trash we have Macon County prisoners permitted to sit on their butts,
while we feed and provide shelter and health and dental care for them. Prisoners dressed in orange jump
suits can be seen picking up trash in Lee County throughout the year. Lee County officials hold their
litterers responsible for their actions and utilize prisoners to clean their streets while Macon County is
unable to do so. To describe some of our road right-aways as filthy is an understatement; check out the
intersection of Macon highways 39 and 54, broken bottles, pampers, cans, and every other imaginable
item.
UPDATE: April 17th As part of the Macon County clean up my daughter-in-law, two of my grandchildren, and I picked up 9 tires and 11 bags of garbage along Hwy 54 West in less than 1/2 mile stretch. Less than 10 minutes after we finished and before we could properly dispose of this road litter at least 3 soda bottles were along part of the highway we just cleaned. Only TRASH litters.

Macon County Planning Ordinance
This is not to be taken lightly. Why is this commission working so hard and with such intensity?
The Ordinance Preamble reads An ordinance, in pursuance of the authority granted by Act no. 2001-562 enacted by the Legislature of Alabama, May 2001 to provide for the establishment of districts within Macon County, Alabama: to regulate within such districts the height, number of stories, and size of buildings and other structures, the percentage of lot that may be occupied, the size of yards and other open spaces, the density of population and the use of buildings, structures, and land, and to provide methods of administration of this ordinance and penalties for the violation thereof.
I am sure you know who this legislation is to benefit. The Planning Commission and Macon County through collection of unnecessary fees. There is no benefit for me in being told how I may use my property for legal activities. There are laws on the books not fully enforced now so why have more laws and bureaucratic growth at a time when Macon County is experiencing financial belt tightening.
If you do not want to give up your rights to freely use your property then do not sign a petition being taken door to door here in Macon County and should it get on a ballot vote NO or give up your property rights and continue paying ad valorum taxes.
The Commission meets the 3rd Tuesday of each month at 6:00 pm at the Macon County
Courthouse.

If you are happy with paying 9% sales tax in Opelika and Auburn, then skip over this section. You may find it interesting that both cities unanimously approved the identical increase in their sales tax on June 21, 2011, quite possibly during the same hour. How about in less than a week the Opelika City Council struck again and passed a sewer rate hike. FOOD for THOUGHT: if my friend, a veterinarian, arranged with neighboring veterinarians to raise their costs for rabies vaccines to take effect on the same day would that not be collusion which is defined as secret activities of people who work together to do something illegal or underhanded?

Items of concern for 2012 State Legislative Session
- Initiative and Referendum, HB201, has been before our Legislature for seven sessions and not once got out of committee. 'Sez sum'in to me like it is too good for the citizens and therefore distasteful and threatening for the Legislators.
- Alabama Fair Ballot Language - efforts to find a sponsor to bring it before the Legislature. Will be a great service to all voters.
- Primary voting - remove restrictions of choosing one party. Enable us to vote for candidates from both parties. It is the state, as compared to the parties, who must cough up the money for primaries - and WE are the state.
- Mandatory Drug Tests for folks on governmental handouts; similar to what Senator Beason introduced in 2010.
- Cahaba River -why is the federal government through the back door and strong arm tactics want the land from over 1000 landowners along the Cahaba River in Alabama? This river is the largest river in Alabama. The feds want 176,000 acres in conservation easements and want to purchase 130,000 acres. Why? Control the water, control the people. Read more.

Notes to remember going into Alabama 2014 Elections
Lets look at some facts and how some Alabama legislators voted on issues important to us.
- SB2 during the Ethics Special Session called by Governor Riley in December 2010 (after the Iron Bowl ticket give-away). As reported by Dr. Terry B., these Republicans voted against the measure of prohibiting union dues from being automatically deducted from a state employees' check, similar to the position of the AEA. Nothing in the bill prohibits cash, check, or credit card contributions. These Republicans deserve to be watched for their not supporting this bill: Alan Baker (R-Brewton who represents Escambia and Baldwin Counties), Alan Boothe (Nov 2010 switched to Republican Party. R-Troy who represents Pike and Dale Counties), Owen Drake (R-Leeds who represents Jefferson and St. Clair Counties ), Allen Farley (R-McCalla who represents Jefferson County ), Todd Greeson (R-Ider who represents DeKalb County), Mike Hill (R-Columbiana) Shelby County, Steve Hurst (Nov 2010 switched to Republican Party. R-Munford who represents Talladega and Calhoun Counties), Ron Johnson (R-Sylacauga who represents Talladega and Coosa Counties), Mike Millican (Nov 2010 switched to Republican Party. R-Hamilton who represents Marion and Winston Counties), Jeremy Oden (R-Vinemont who represents Cullman, Blount, and Morgan Counties), Arthur Payne (R-Trussville who represents Jefferson County), Harry Shiver (R-Bay Minette who represents Baldwin, Conecuh, Escambia and Monroe Counties), Elwyn Thomas (R-Oneonta who represents Blount and Jefferson Counties), Allen Treadaway (R-Morris who represents Jefferson County), and Lesley Vance (Nov 2010 switched to Republican Party. - Iron Bowl 2010 tickets, 366 tickets at face value of nearly $24,000, given to government employees and elected officials for the game in Tuscaloosa on November 26th, only days before the convening of the special session to legislate ethics laws. It appears the Governor felt best to convene the session after this unethical ticket and free parking pass giveaway. So much for believing in what is right, just watch the other hand. Mr. Jim Metrock, President of www.Obligation.org pressed hard for the ticket handout information from the University of Alabama. You can read Mr. Metrock's comments and see who received tickets and their seating on his web site. I am disappointed in Legislators Mike Ball, my champion of ethics reform, Paul DeMarco, and Jabo Waggoner all whom introduced ethics reform legislation days later in the special session. - BCS tickets. Being able to purchase tickets to the AU vs Oregon football game was not possible for many AU facility and staff. However, if you are a Legislator you could have purchased tickets at face value for the bowl game bypassing employees. Some say the seats are not the best but they are in the stadium unlike many AU staff and facility who could not get tickets. Lets see who was able to purchase these highly sort-after tickets: Senators Gerald Allen, R-Tuscaloosa; Roger Bedford, D-Russellville; Scott Beason, R-Gardendale; Dick Brewbaker, R-Montgomery; Ben Brooks, R-Mobile; Gerald Dial R-Lineville; Marc Keahey, D-Grove Hill; Shadrack McGill, R-Woodville; Del Marsh, R-Anniston; Greg Reed, R-Jasper; Paul Sanford, R-Huntsville; Jabo Waggoner, R-Vestavia Hills; Cam Ward, R-Alabaster; and Tom Whatley, R-Opelika and Legislators include Jim Barton, R-Mobile; Alan Boothe, R-Troy; Dwayne Bridges, R-Valley; Greg Canfield, R-Vestavia Hills; Chad Fincher, R-Semmes; Richard Laird, D-Roanoke; Jay Love, R-Montgomery; Barry Moore, R-Enterprise; Harry Shiver, R-Bay Minette; Randy Wood, R-Anniston; and Greg Wren, R-Montogmery. - 62% pay hike. These individuals deserve our recognition for turning down the 62% pay hike upon entering the 2011 session Representative Paul DeMarco and Senators Del Marsh, Phillip Williams, Bryan Taylor and Ben Brooks. Senator Williams and Taylor are the ONLY freshmen not taking the pay raise. Bryan Taylor, provided in a news release of January 4, 2010, that he will honor his campaign pledge to work for the repeal the entire pay raise. In the interim Taylor is not willing to accept the pay raise and to turn the money back to the state. He will however, place the money into an interest bearing account and will use the account to help first-year school teachers with their in-classroom expenses (ref: Taylor news release January 4, 2010). Hear hear. Here is a Montgomery Advertiser news clip of the voting record that day personal checkbooks were taken care of before ANY state business.
Alabama House District 82
District 82 covers Macon County and parts of Bullock and Lee Counties
- Representative Pebblin Warren of Tuskegee
- UPDATE August 28, 2010. What a difference a few months make. Before the primary election Representative Warren and I spoke of our families and the campaign trail before a Notasulga forum of the candidates. Less than 3 months later she refused to shake my hand at the Macon County Family Day celebration of all places! Could the sudden change in attitude toward me have something to do with me being honest with her in telling her I would not vote for her because of 1) she being a double dipper, 2) she being one of 6 legislators suing the state to continue to receive benefits from two state agencies for the same day's work, 3) me being critical of her introducing a bill that became law effecting her husband's office, Macon County Sheriff's department RETROACTIVELY (HB117 2009) , 4) voting herself a massive 62% pay raise with an automatic adjustment EVERY YEAR, while people are losing their jobs, homes, and livelihoods, 5) not supporting the quality of education she preaches of so often (SJR9 of 2010), may have been influenced by the strong and powerful Alabama Education Association who gave her $10,000 to encourage her vote the way they want as compared to what is right, or 6) I am working for a Conservative on the Republican November ballot effecting our district? Her actions Says volumes of the leadership we have in Montgomery. Go fig'r. She should also explain why as only her second sponsored piece of legislation provided for Relating to Macon County; to provide for the compensation and expenses of the local elected officials; and to provide for retroactive effect, HB233 2006, as well as providing pay raises for other county elected officials.
- Gourmet Beer Bills. Voted in favor three times since 3Apr2007 in favor of Gourmet Beer; 3Apr2007 HB195, twice on 3Mar2009 for HB373. 2007 was a great session - passing bills for beer and their 62% pay raise. It is no wonder nothing gets done in Montgomery when bills such as these are passed and budgets, healthcare, education are of less importance.
- Our Representative Warren has scored a terrible 44% from the National Foundation of Independent Businesses on her voting record as it effected small business issues from 2007 and 2010. Always easier taking care of herself and fellow elected officials with pay raises and benefits.
- Let us not forget she was one of the many Democrats and some Republicans, who not once but twice, voted for their illegal 62% pay raise in 2007 taking their pre-2007 part-time salary of $28,000 to now over $54,000 at the same time she has worked hard to increase Macon and Lee County taxes.
- Introduced (HB604 2011) and was signed into law mandating a Macon County business tax
- Introduced and was signed into law for Lee County to be able to levy sales and user taxes (HB540 2011) in the county.
- Abstained for limiting abortion (HB18 2011)
- Wants to put 6 year olds in school (HB6 2011), but writes of her concerns about large class sizes for teaches, and choose not to vote to place teacher accountability into the state code (SJR9 2010)

Alabama House 83
Other Alabama House Districts
- House District 17: Mike Millican. Includes Marion and Winston Counties, won as a Democrat on 2Nov2010 and also was welcomed into the Republican isle with open arms less than 3 weeks later. Representative Millican voted against passage of SB2, as most Democrats did and which prohibits collection of dues from government paychecks for political active organizations during the Ethics Special Session of 2010. As a reward (bribe?) for suddenly seeing the light he was assigned a Vice Chairman of the House Health Committee AND Chairman of Health Care Costs of the Health Committee.
- House District 35: Steve Hurst. Includes Calhoun and Talladega Counties, also won as a Democrat on 2Nov2010 and within 3 weeks was also warmly accepted into the Republican Party. Hurst also voted against passage of SB2, as most Democrats did and which prohibits collection of dues from government paychecks for political active organizations during the Ethics Special Session of 2010. Most Democrats and 3 or the 4 newly converted Republicans voted against the measure. Representative Hurst for his good behavior in turning colors was welcomed into the Republican isle with the Chair of Services Sub-Committee of Financial Services Committee AND Vice Chair of Agriculture and Forestry Committee AND Petroleum and Waterways Sub-Committee of Agriculture and Forestry Committee.
- House District 79: Mike Hubbard. (Lee County) as Speaker of the House and in cahoots with the Senate Pro Tem, Senator Del Marsh, decided that citizens are a security risk to the Legislators and therefore can not visit our elected officials in their offices on Legislative days and to make appointments on Tuesdays and Thursdays. Get real! A must read - caution it may make you sick. UPDATE: because of TEA Party pressure, the leadership kicked back some to rethink and regroup. And for Vance's reward of switching parties he received Vice-Chair of Financial Services Committee AND Chair of Regulations Sub-Committee of Financial Services Committee AND Chair of K-12 Sub-Committee of the Educational Committee.

Most Democrats and 3 or the 4 newly converted Republicans voted against the measure. For his reward (bribe?) for seeing the light, Boothe was given the Chair of the Public Safety Subcommittee of the Public Safety and Homeland Security Committee AND Chair of Internal Affairs Committee.

- Dr. Ethel Hall, District 4, her 24 years of tenure must expire in 2012. Read this email of her rudeness about she wanting to cookie cut our children's education.
- We must remember Randy McKinney of District 1, Dr. Ethel H. Hall of District 4, Ella Bell of District 5 including Macon County, David F. Byers, Jr of District 6, Gary B. Warren of District 7, Dr. Mary Jane Caylor of District 8 and Governor Bob Riley voted for CCSSI standards for our Alabama students. They have directly given our right to regulate what our children learn to the federal government. Betty Peters, District 2, and Stephanie Bell, District 3, did the right and honorable thing by voting against this disaster. Governor Elect Bentley urged that this issue be explained to voters and voted upon when the new Board is in place in January 2011.
